What is a Strata Title?

A strata title is a type of land title issued for individual units within a multi-story building, such as apartments and condominiums, giving owners legal ownership of their specific unit and a share of the common property. Before a strata title is issued, the entire property sits under a master title held by the developer. Once the land office issues individual strata titles, the developer is legally required to transfer the title to the buyer through a process known as perfection of transfer.

Freehold Strata Transfers in Bukit Jalil

The transfer process differs depending on whether your property is freehold or leasehold. Most Bukit Jalil projects on our site are freehold, including Ayanna Residence, OAKA Residence, Kingswoodz, Vividz, Veladaz, Park Green, Ren Residence, and Residensi Andalan. For these freehold properties, transferring the strata title from the developer to the owner is relatively straightforward. Once the developer's lawyers prepare the Memorandum of Transfer (MOT), it can be executed, stamped, and registered at the land registry without needing external consent.

Leasehold Strata Transfers and State Consent

In contrast, leasehold developments in the area have different requirements. Leasehold exceptions like Bukit Jalil Family Suites (/projects/bukit-jalil-family-suites/) and The Queenswoodz (/projects/the-queenswoodz/) require written consent from the state land office before the strata title can be transferred or charged to a bank. Obtaining this state consent typically takes 30 to 90 days depending on the land office and pauses the standard 3-month completion clock for a subsale, on top of a separate legal fee for the consent application (RM200 for properties valued RM100,000 or less, RM500 for RM100,001 to RM1,000,000, or RM3,000 above that, reduced to RM500 if the application is only for a consent to charge).

Steps to Perfect Your Strata Title

To perfect your strata title, you must appoint a lawyer (either the original SPA lawyer or a new firm) to handle the paperwork. The lawyer will obtain the developer's signature on the MOT, calculate the stamp duty payable based on the original purchase price or market value — 1% on the first RM100,000, 2% up to RM500,000, 3% up to RM1,000,000, and 4% above that for citizens, or a flat 8% for foreign buyers — and submit the documents to the Inland Revenue Board (LHDN) for assessment. After paying the stamp duty, the MOT is submitted to the Land Registry for registration. Once completed, your name will officially appear on the strata title document as the registered proprietor.
